Terms and Conditions This page advises the terms and conditions on which we supply any of the products to you. Please note that if you order any products from Creative Laser Cutouts, you agree to be bound by these terms and conditions. Information About Us Creative Laser Cutouts is a sole trading business and therefore does not have a business registration number or is registered for VAT, at the time of the drawing up of these terms and conditions. Risk and Title The Products will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges. Branding We do affix our website details onto all of our products (except acrylic products). This is done by means of a small white label and is carried out in a tasteful and neat fashion and will be at the rear of the products. Approval of electronic proofs for Wedding Items Proofs of wedding item wording will be sent prior to any printing taking place. These proofs will need approval by the client (via e-mail) in order for us to commence with printing. Any alterations requested by the client after approval of the proofs, providing work has not commented on the order, will incur an additional cost. We cannot make any alterations to orders which we have already commenced processing. A delays in approval of proof will in turn cause a delay in the proposed delivery date. In the event that you receive your invitations and notice an error which was on the proof that was approved by yourself, an additional charge will apply for re-printing the inserts. Should the inserts be affixed to the invitation, we will require you to return the invitations to ourselves (delivery to be paid by client) and a fee will apply for the re-printing and re-affixing the inserts. We can also not guarantee that the laser cut sleeves will remain intact when removing the inserts and any damaged sleeves will be replaced at a cost to the client. Re-delivery fees will be billed to the client. It is therefore vital to check your proofs carefully. Materials We are solely reliant on our suppliers as to the quality and colour of the materials we utilise. We do experience colour shade and thickness variations in the card we use and therefore, your sample may vary slightly in colour or thickness from your ordered items. Your ordered items will however be cut from the same batch of card, ensuring even colour and thickness throughout. Please note that although we endeavour to show the accurate colour of materials electronically, we cannot guarantee that the colour we have and the colour you see on your computer screen is a perfect match and can therefore not be held liable for any variations in shades. For embellishments that are not available at the time of order, we will endeavour to replace any items that are not available with a similar item. Laser cutting does leave a browned edge that is more visible on lighter coloured card. We do however use the cleaner side of the cut card on the outside of your invitation to reduce the browned edge look. Please note that any photographs / images shown or supplied by Creative Laser Cutouts may not truly represent the actual colour, shade or texture of the item supplied. It is advisable to order a single item in the colour you require to ensure colour and texture match. As all of our items are laser cut and then assembled by hand, there may be a size variation within the products. Pricing & Payment E-bay items: Pricing is provided per the description of the item. Any additional items will be quoted for at the time of the quotation request. We will not be held responsible for replacement of items or refunds of any items if the buyer has not carefully read the e-bay description. Quoted items:  Quotations are valid for the period as stated on the quotation. Payments is upon receipt of the invoice. No order will be processed until such time as full payment is received. Pricing is based on a range factors;  the quantity of items you require as well as the card stock type, the card colour and print colour of your inserts,  the weight and colour of your envelopes and the type of embellishments will affect the price and a quotation will be prepared based on your specific  requirements.  We do alter our pricing from time to time and therefore have a 30 day validity on all of our quotations, whether noted on the quotation or not. The onus is on the client to obtain an updated quotation or confirmation of pricing prior to placing an order or in the case of distribution, prior to quoting your client. Delivery While we will make best efforts to ship products to you by the indicated date, we are not responsible for delay in shipping. The delivery date quoted is done so at the time of quotation this may vary dependent on the date of order and date of payment. An accurate delivery date can be provided upon making payment. Advice regarding order shortages or damage in transit must be put in writing via the contact page on the website no later than 7 days after receipt of  products (refer to our returns policy below). We do not accept liability for any claims made after that time. Shipping is complete when the products reach the address per your e-bay delivery details (when placing an order via e-bay) and your Paypal payment advise (when paying via a paypal invoice). Should an address not be specified on your order, we will use the address per your payment method. We cannot be held liable if the address on your order or payment method is not current and will not process any refunds or replacement of goods that have been sent to the incorrect address if this is the address on your order or payment method.   Should any items be returned to ourselves via the postal system or courier service, the re-delivery of such item will be at the cost of the client. Should any international orders incur customs, excise or tax fees, these are payable by the client. We ensure that our item descriptions are accurate and will not be held liable for any delays or fees incurred if the items are withheld by customs. It is the clients responsibility to confirm any restrictions imposed by customs in their  country of residence / delivery country, prior to placing an order as we do often use natural products on our items, some of which are prohibited by certain countries e.g. feathers. Returns We do our very best to ensure that you are happy with your purchase. Where any claim is made against us, we may in our absolute discretion choose to replace the products or to refund the cost to you. Any warranty claims must be made as soon as the defect is reasonably apparent and in any event, no later than 7 days after shipping of the products to you. Under no circumstances will we refund or replace any products that have been tampered with, altered in any way or partially used.  Where the products are defective, you must provide us with full particulars of the product order, the nature of the defect and such other details as we may require. Do not return the products to us unless we request you to do so. We will request you to return the product if a refund is to be processed. Should we agree to a refund, the items in question need to be returned to ourselves within 3 working days of the refund agreement. The cost of returning the items is for the account of the client. We will only process a refund upon receipt of the goods. We will not refund or replace goods because there is a problem with your choice of materials, an error on your inserts or they don’t turn out as you expect. Please note that shipping charges are not refundable and we are not liable to pay for shipping on any returned items.  Loss We will not be liable to you or to any third party for any indirect or consequential loss or damage of any kind, or for any loss of data, profit, revenue, business or management time, howsoever caused. You agree that our liability in relation to the purchase of any product (whether arising in negligence or otherwise), will not under any circumstances  exceed the greater of £200 or an amount equal to the sums paid or payable by you for the purchase of that product. The foregoing paragraphs do not affect your statutory rights as a consumer. Nor do We exclude or limit in any way our liability: for death or personal  injury caused by Our negligence; under section 2(3) of the Consumer Protection Act 1987; or for fraud or fraudulent misrepresentation; or for any  matter for which it would be unlawful for us to exclude, or attempt to exclude, our liability.   Intellectual Property Manufacture We warrant only that the products manufactured by us meet your specifications and are manufactured in accordance with usual processes and standards. We do not guarantee that the product will be fit for any particular purpose. Any alterations requested by the client after approval of proofs or drawings, providing work has not commenced on the order, will incur an additional cost. We cannot make any alterations to orders which we have already commenced processing, therefore it is vital to check your proofs carefully. Unless otherwise requested, when providing self assemble invitations, these will be provided with crease lines (where required) but will be provided unfolded. Please ensure that you request folding upon paying for your order if this service is required. We may from time to time alter the size of our pre-designed invitations. Due to the timing between purchasing a sample invitation and placing your order we advise that you request the updated size of the invitations. We will not replace, refund in full or pass a partial refund for invitations that are a different size to the sample provided. Our invitations are sized in accordance with standard UK envelopes. Should you require a specific size from our pre-designed range, please advise upon requesting a quotation as the price will vary depending on the size required. Bespoke Design Service We offer a bespoke design service under the following terms and conditions: - You provide a high res image via e-mail - We re-draw the image into the laser software and run a trial cut - We advise on any adjustments that may be needed - You receive a drawing of your design via e-mail - Two sets of changes are permitted (up to a total of 15% change to the design) The changes are only permitted at the time of the              design and may not be ‘taken up’ or ‘banked’ for a later date - A final drawing of your design is sent via e-mail - A quotation can now be prepared based on this design in the colour and card type of your choice The cost of this service is dependent on the level and detail of your drawing / design. We would require an e-mailed image in order to provide an accurate design fee. A sample price and delivery fee for the sample will be provided. Should you not wish to go ahead with the design, we will not issue a refund for the design fee. However, if you decided at a later stage to continue with the design project, a further quotation for design fees will be provided. You retain all intellectual property rights, including copyright, in those files/ designs that you have provided in hard copy, CD or emailed to us where you already own such rights. Creative Laser Cutouts retains the property and sale rights for any designs which it has been commissioned to do. We do not provide a drawing of the design as part of the sale package. A cut sample will be provided. Our designs may not be provided to another laser cutting company for manufacture and legal action may be taken against any other company found to have copied our designs.   Reasonable Control We shall not be liable for any failure to perform our obligations under a contract that is caused by matters beyond our reasonable control. Without  limiting this in any way, this including strikes, lock-outs or other industrial action, riot, war, terrorist attack, fires, storms, floods or earthquakes,  impossibility of the use of transport or of communication networks, restrictions imposed by government, delays caused by faulty equipment / machinery or breakdown of our equipment/machinery. Our performance under any contract is deemed to be suspended for the period that the matter beyond our control continues and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the matter to a close or to find a solution to the matter.  Changes to these Terms and Conditions We have the right to revise and amend these terms and conditions from time to time.  Severability In the event that any of these terms and conditions is held to be unenforceable or invalid by a competent authority or by judicial decree or decision, the remainder of these terms and conditions shall remain valid to the fullest extent permitted by law.   Entire Agreement These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject  matter of any Contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing. We each acknowledge that, in entering into a contract, neither of us has relied on any representation, undertaking or promise given by the other or be  implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these terms and conditions. Neither of us shall have any remedy in respect of any untrue statement made by the other, whether orally or in writing, prior to the date of any contract  (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and  conditions.
